How do I set up 7shifts to stay compliant with California meal break rules and correctly identify when meal break penalty pay is required?

Answer

To ensure California meal break compliance, enable California Labor Compliance, turn on Employee Attestation, and use the Labor Exceptions Report to review and process any required meal break penalty pay. California law requires employers to pay one additional hour of regular-rate pay for each day a legally required meal break is not provided correctly.

⚠️ You must have Admin or Manager permissions to access these settings. You must also have the Time Clocking enabled.

  1. Log in as an Admin.
  2. In the left navigation bar, select Company Settings.
  3. Select Labor & Compliance.
  4. Make sure that California Labor Compliance is enabled.
  5. In the Employee Attestation section, make sure the feature is turned on. When this feature is enabled, employees are prompted at punch-out to confirm whether they took their breaks, had the opportunity to take them, or were prevented from taking them.
  6. To easily view and process these exceptions, go to the Labor Exceptions Report. This report is accessible to Admins and Managers and provides the data from Employee Attestation, showing which employees chose to waive their breaks.
  7. (optional) If you would like to have the system automatically dismiss missed breaks, you can turn on Automatically Dismiss Missed Meal Breaks in your Labor & Compliance settings. Instead of showing up a missed meal break as a violation in reports, 7shifts will recognize that it as valid because a waiver applies.
